Terms of Service

The rules that keep swaps fair.

Legal, yes — but written to be readable. Each section starts with a plain-language summary, followed by the full wording. Last updated: 26 July 2026.

1. What playloop is

In plain language

We're a platform that helps families in a community swap toys with each other using points. We don't buy, sell, own or ship any of the toys — families exchange directly with each other.

Playloop ("playloop", "we", "us") operates a community toy exchange for families with children aged roughly 0–6. Members list toys they no longer need, earn Playloop Points, and use those points to request toys from other members in their community.

Playloop is an intermediary service. We are not a marketplace trading on our own account, not a retailer, not a distributor, and not a party to any exchange between members. No money changes hands between families on playloop. Toys are exchanged for points, and points are an internal accounting unit only (see section 4).

By creating an account or using the site, you agree to these terms and to our Privacy Policy. If you don't agree with them, please don't use playloop.

2. Who can use playloop

In plain language

You must be 18 or over and a parent or guardian. Accounts are for individuals, not for businesses, and never for children.

  • You must be at least 18 years old.
  • Accounts are for parents, guardians and caregivers acting in a personal capacity. Children may not create or use accounts, and playloop is not directed at children.
  • Accounts are personal and non-transferable. One account per person; one household may hold one account unless we agree otherwise in writing.
  • Businesses, retailers and resellers may not use member accounts to distribute stock. Organisations wanting to work with us should use Partner with us.
  • Some communities are invite-only and require a community code from a partner organisation or an existing member.

3. Your account

In plain language

Keep your details accurate and your login to yourself. You're responsible for what happens on your account.

You agree to provide accurate registration details, keep them up to date, and keep your login credentials confidential. You are responsible for activity that takes place under your account. Tell us straight away at hola@useplayloop.com if you think someone else has access to it.

We verify accounts (including by phone number) to keep communities genuine and to prevent duplicate or fraudulent accounts. Refusing verification may limit what you can do on the platform.

4. How Playloop Points work

In plain language

Points are an in-platform accounting unit. They have no cash value, can't be bought or sold between members, can't be exchanged for money, and expire at the end of a terminated membership cycle.

  • Earning. New members receive a one-time welcome balance of 5 points when their first listing goes live. After that, points are earned by completing swaps with other families, and through occasional community activity such as referrals.
  • Spending. Points are spent when you request and receive a toy from another member. The point value of a listing is set within the ranges the platform allows.
  • No cash value. Points are not money, not e-money, not a payment instrument and not a security. They are not redeemable for cash, not refundable, and cannot be transferred, gifted, sold or traded outside the platform.
  • Top-ups. Where Premium members can purchase additional points, that purchase buys access to platform functionality, not a monetary balance, and is non-refundable once the points are credited except where EU consumer law says otherwise.
  • Expiry. Points remain available while your membership is active. If your membership is terminated or cancelled, any remaining points expire at the end of the membership cycle in which the termination takes effect and cannot be reinstated or exchanged.
  • Corrections. We may adjust, withhold or remove points obtained in error, through a failed or reversed swap, or through conduct that breaks these terms.

5. Listing a toy

In plain language

List only toys that are yours to give, safe, clean and honestly described — photos and condition included.

When you list a toy, you confirm that:

  • the item is legally yours to give away;
  • it is complete, clean and functional as described, and any damage, missing parts or wear is disclosed in the listing;
  • photos are your own and show the actual item you are offering;
  • the item is safe, age-appropriate, and complies with applicable EU toy safety rules — including that it is not subject to a safety recall, does not have broken or detachable small parts that create a choking hazard, and does not contain leaking batteries or damaged electrical components;
  • the item is not on our prohibited list (see section 10).

Listings are reviewed before they go live. Review is a good-faith check of the information you provide — it is not a physical inspection, a safety certification or a guarantee of condition.

6. Meeting up and completing a swap

In plain language

Meet somewhere public, check the toy when you collect it, and confirm the swap honestly in the app.

  • Arrange handovers in public, family-friendly places wherever possible, and use your judgement about your own safety.
  • Inspect the item at handover. If it isn't as described, don't complete the swap — raise it with the other family and, if you can't resolve it, with us.
  • Confirm completion in the platform promptly and accurately. Points transfer on confirmation.
  • Be reliable and communicate. Repeated no-shows, late cancellations or unconfirmed swaps may affect your account.
  • Clean and check items before passing them on, and follow the guidance on our Trust & Safety page.

7. Our role and the limits of it

In plain language

Families exchange directly with each other and are responsible for the condition and safety of what they hand over. We facilitate and can help mediate, but we're not a party to the exchange and we can't guarantee any toy or any member's conduct.

Playloop provides the platform. The exchange itself is between the two families. The member offering a toy is responsible for its condition, safety, cleanliness, completeness and accurate description. The member receiving it is responsible for checking it, for supervising their child's use of it, and for deciding whether it is appropriate for their family.

We do not own, inspect physically, test, certify, store, repair or transport any item exchanged on playloop, and we make no warranty as to the condition, safety, legality, age-suitability or availability of any listed toy, or as to the identity, conduct or reliability of any member.

We may, at our discretion, help mediate a dispute between members — for example by reviewing messages and listing details and suggesting a resolution, including a points adjustment. Doing so does not make us a party to the exchange and does not create any obligation to mediate in future.

To the fullest extent permitted by law, playloop is not liable for indirect or consequential loss, or for loss or damage arising from an exchange between members, including injury or damage caused by an item obtained through the platform. Nothing in these terms limits liability that cannot be limited by law — including liability for death or personal injury caused by our negligence, for fraud, or any statutory rights you have as a consumer under Spanish and EU law.

The platform is provided on an "as is" and "as available" basis. We work hard to keep it running but do not promise uninterrupted or error-free service.

8. Moderation and enforcement

In plain language

We can edit, reject or remove listings and suspend or close accounts that break these rules. We'll tell you why where we can.

We may reject a listing, ask you to change it, remove it, hide content, limit account functionality, remove or adjust points, or suspend or terminate an account where we reasonably believe these terms have been broken, where an item may be unsafe, or where conduct puts other families at risk.

Except where it would be unlawful or unsafe to do so, we'll explain the reason for a removal or suspension and give you a way to respond. You can appeal any decision by emailing hola@useplayloop.com; a person, not an automated system, reviews appeals.

9. Premium membership, billing and refunds

In plain language

Premium is an optional paid subscription billed through Stripe. Cancel any time and you keep access until the end of the period you've paid for. Prices shown are the total price — no VAT is added.

  • Plans. Playloop is free to use. Premium is offered on a monthly or annual basis, as shown on the Membership page.
  • Payments. Payments are processed by Stripe. We don't store your card details. Your card details are handled by Stripe under its own terms and privacy policy.
  • Renewal. Subscriptions renew automatically at the end of each period at the then-current price until cancelled. We'll notify you in advance of any price change.
  • Cancellation. You can cancel at any time from your account settings. Cancellation takes effect at the end of the current billing period; you keep Premium access until then and are not charged again.
  • Taxes. Playloop is operated by a US-registered entity and prices are shown as the total amount payable, with no VAT added at checkout.
  • Refunds and withdrawal. Where you have a statutory right of withdrawal as an EU consumer, you may cancel within 14 days of starting a new subscription for a refund, unless you asked us to start the service immediately and have used it, in which case we may deduct a proportionate amount for the period used. Beyond that, we don't refund part-used periods, but if something has clearly gone wrong on our side, email us — we'd rather sort it out than argue about it.
  • Purchased points. Points credited to your account through a top-up are consumed on use and are not refundable once credited, except where the law requires otherwise.

10. Things you may not do

In plain language

No fake listings, no cash deals, no harassment, no unsafe or recalled items, no gaming the points system.

  • Post fake, misleading, duplicate or inaccurate listings, or use photos that are not of the item offered.
  • Ask for or accept money, or offer to sell, rent or barter items for cash or other consideration, in connection with a playloop exchange — including moving a conversation off-platform to do so.
  • Manipulate the points system: creating multiple or fake accounts, faking swaps or reviews, abusing referrals (referral bonuses are limited to one per verified phone number), or exploiting bugs.
  • List unsafe items: anything subject to a safety recall, broken or hazardous items, counterfeit goods, items with damaged electrical parts, or anything that isn't a children's toy or related family item.
  • Harass, threaten, discriminate against, spam or impersonate other members or our team.
  • Collect other members' data, scrape the platform, reverse engineer it, or use it for commercial or advertising purposes.
  • Use playloop for anything unlawful, or share content you don't have the rights to.

11. Your content

In plain language

Your photos and words stay yours. You give us permission to show them on playloop so swaps can happen.

You keep ownership of listings, photos, reviews and messages you create. You grant playloop a non-exclusive, worldwide, royalty-free licence to host, store, display, resize and distribute that content for the purpose of operating and promoting the service. We'll ask you separately before using your story or photos in marketing. You can delete your content, and deletion ends that licence for future use.

12. Ending your membership

In plain language

You can leave whenever you like. We may close accounts that break the rules. Remaining points expire when the cycle ends.

You can close your account at any time from your settings. Outstanding swaps should be completed or cancelled first. We may suspend or terminate an account for a serious or repeated breach of these terms, for conduct that endangers other families, or where required by law — with notice unless immediate action is needed.

On termination, your access ends, active listings are removed, and any remaining points expire at the end of the then-current membership cycle. Data handling after closure is described in the Privacy Policy.

13. Governing law and disputes

In plain language

Talk to us first — most things get resolved by email. If they don't, EU consumers keep the protection of their local law and courts.

Please contact us first at hola@useplayloop.com so we can try to resolve things informally. If we can't, these terms are governed by the laws of Spain for members resident in Spain, and by applicable mandatory consumer law elsewhere in the EU. If you are a consumer, you may bring proceedings in the courts of your place of residence, and nothing here deprives you of the protection of the mandatory rules of your country of residence.

EU consumers can also use the European Commission's Online Dispute Resolution platform. Disputes between members about a specific exchange are between those members; we can help mediate but are not a party to them.

14. Changes to these terms

In plain language

If we make a meaningful change, we'll email you at least 30 days beforehand and update the date at the top of this page.

We may update these terms as the product changes or the law requires. For material changes we'll give at least 30 days' notice by email and in the app before they take effect. If you don't accept a change, you can close your account before it takes effect. Minor clarifications take effect when published.
